THE ADMINISTRATION OF THE ESTATE OF SAMUEL CARPENTER;  1873

Know all Men by these Presents, That we Susan A. Carpenter ,  Stephen Willson, James Lockhart & James Brown  are held and firmly bound unto the people of the State of New York in the sum of.....
.Fifteen Hundred Dollars           to be paid to the said people;  which payment well and truly made,
we bound ourselves and each of our Heirs, Excuters, and Adminstrators, jointly and severally, firmly by these presents.

Sealed with our seals.   Dated this  13th Day of March in the year of our Lord, one thousand eight hundred and 73.


The conditioning of the Obligation,   That if the above bounden,  Susan Carpenter,
& Stephan Willson   administrate all and singular goods, chattels, and credits of
Samuel Carpenter   deseased, shall faithfully execute the trust reposed as such and also if the said 
Susan A.Carpenter  & Stephan Willson shall obey all the orders of the County of Allegany touching the administration of the Estate committed to them,  then the above obligation to be void: otherwise to remain in full force and virtue.        Susan  A Carpenter

The suret being named in the above bond, being duly sworn both and each say that they are residents of the County of Allegany Co., that they are free holders and are worth more than fifteen hundred, over and above all just debts and libilities existing against them and over and above any property exempt from seizure or excution.

That during the whole of te year of 1873-1874 he was publisher and proprietor of the Angelica Republican, above named, a weekly newspaper published at Angelica, in said count;  that the noticed mentioned in said agreement was published as stated therein, and that the same has not been paid or satisfied in any part thereof.

The Will of Benjamin Rogers    1806
This copy of Benjamin Roge's Will  was kindly emailed  to me by  K--------------  It Can also be found on Roots Web.  Sent to them by Carolyn Carter Johnson in June, 2000. (Carolyn states that paragraphs and periods added by her.) Benjamin Rogers was the grandfather of our 2nd.great uncle, Randolph Rogers, the Civil War Sculptor and our 4th great Grandfather.             Dawn Davies Carpenter
In the name of God amen    I Benjamin Rogers of the town and county of Saratoga and the state if New York  being weak in body but of sound and perfect mind and memory do make and publish this my last will and testament in manner and form following
That Is to Say

First I give and devise to my beloved wife Mary Rogers whom I hereby appoint my Executrix  of this my last will and testament  the third part of my real Estate so long as she remains a widow.

I give and bequeath to my eldest son  Benjamin Rogers  Jun.  Fifty Dollars to be paid to him in neat(?) stock or horses.

I give and devise to my next eldest son  Jeremiah Rogers  his heirs and assigns one equal quarter of the farm to hold to him the said Jeremiah Rogers his heirs and assigns forever.

I give and bequeath to my third son Caleb Rogers { ink blot} Dollars.

I do also give to my fourth son  John Rogers  thirty Dollars.

I give and devise to my youngest sons Issac and Joel their heirs and assigns the remaining three quarters of this my farm to be equally divided between them to hold to them  the said Issac and Joel  their heirs and assigns forever together  with which I give and bequeath to equally divided between them.

I also give and bequeath to Germima Swartout    one Dollar

I also  give and bequeath to Mary Wiggins    one Dollar

I also  give and bequeath to Margaret Smith    one Dollar

I slso give and bequeath to Phebe Wilcox    one Dollar

and lastly I also give and bequeath to my youngest Daughter Elizabeth Rogers two cows and farm __?__ sheep together with an equal out set __?__ with my other daughters.

The Devices and Legacies are to be paid to the respected Devisees and Legatees by my wife Mary Rogers my fully appointed Executrix and by  Jeremiah  my son and Cornelius Swarthout my my (sic) son-in-law  whom I hereby appoint my Executors of this my last will and testament so soon as the minors arrive at age and to those already of age as occasions require  yet my younger sons Issac Rogers and Joel Rogers to be holders of the real estate.
In witness there of hereunto set my hand and seal the twenty first day of October  one Thousand Eight hundred and sic.

Signed, sealed, published and declared by the above named Benjamin Rogers to be his last will and Testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the Testator.

Be it remembered that on the fourth day of December in the year of our Lord one thousand Eight hundred and six   personally appeared before me Henry Walton  Surrogate of the County of Saratoga  Mary Rogers  Jeremiah Rogers  and Cornelia Swartout  the executors in the above will named  who wee duly sworn to the faithful performance and execution of the said will.

And be it furthered remembered that on the eighth day of December in the year of our Lord one thousand Eight hundred and six personally appeared before me Henry Walton Surrogate the aforesaid Rhoda Mccarty and Oliver Allin two of the subscripting witnesses to the above written will who being duly sworn in their respective matters __?__ declared that they saw Benjamin Rogers sign (by making his mark) and seal the above writing purporting to be the will & testament of Him the said Benjamin Rogers that they heard him publish and declare the same as such for his last will and testament and all at that time thereof the said Benjamin.
Rogers was of sound mind and understanding to the beat of their knowledge and belief and that the name of Rhoda Mccarty and Oliver Allin subscribed to the said will---of their own handwriting respectively and that they subscribed their names as witnesses thereto in the presence of testator and that John Fichlich __?__ the other subscripting witness to the said will subscribed his name thereto   in the presence of the testator.

Probate of the will of Benjamin Rogers  decd

The people of the state of New York by the grace of God free and independent to all to whom these presents shall come or may concern....Greeting
Know ye that the town of Ballstown in the county of Saratoga on this Eighth day of December in the year of  our Lord one thousand Eight hundred and six before Henry Walton Esquire Surrogate of the said county the last will and testament of Benjamin Rogers deceased  (a copy whereof here to annexed) was proved and is now approved and allowed of __?__ and the deceased diseased having whilst he lived and at the time of his death goods chattels or credits within this State  by means whereof the proving and registering the said will and the granting, administration of all and singular the goods chattels and Credits and also the auditing __?__ allowing and final discharging the account thereof doth belong unto us the administration of all and singular the goods chattels  credits of the said  deceased and any concerning his will is granted unto Mary Rogers Executrix and Jeremiah Rogers and Cornelius Swartout Exetors in the said will named they being first duly sworn will and faithfully to administer the same to makeand exhibit a true and perfect inventory of all and singular goods chattels and Credits and also render a just and true account thereof when hereunto required.

In testimony whereof we have caused the seal of the office of our said surrogate to be hereunto affixed.  Witness Henry Walton Esquire Surrogate of the said County of Ballstown aforesaid the Eighth day of December in the year of our Lord one thousand Eight hundred and six

Samuel Carpenter was the 2nd great Grandfather to the New York branch our Carpenter family
Although not yet proven,  family tradition, the census, and Allegany Co. Records support the theory that this Samuel Carpenter is the grandson of Joshua Carpenter & Sarah Burt.
